Important Notice

This End User License Agreement (“Agreement”) is between you and Cruisimity, not Apple Inc. (“Apple”).

By downloading, installing, or using the Cruisimity mobile application (“App”), you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree, do not download, install, or use the App.

You may review this Agreement at any time within the App under Settings > About > EULA.

1. Acknowledgment

This Agreement is between you and Cruisimity, not Apple.

• Cruisimity, not Apple, is solely responsible for the App and its content
• Apple has no obligation to provide maintenance or support services
• Apple is not responsible for addressing any claims relating to the App

2. Scope of License

Cruisimity grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes on Apple devices that you own or control.

You may:

• Download and install the App on your Apple devices.
• Use the App to explore cruise information, destinations, and related content.
• Access features available through your account.

You may NOT:

• Copy, modify, distribute, sell, lease, or reverse engineer the App.
• Remove or alter proprietary notices.
• Use the App for unlawful or unauthorized purposes.
• Share your account credentials.
• Interfere with or disrupt the App or its services.

3. Accounts

To use certain features, you may be required to create an account.

• You must provide accurate and complete information
• You are responsible for maintaining the confidentiality of your account
• You must notify us immediately of any unauthorized use

4. Notifications

The App may send notifications related to:

• App updates and new features.
• Cruise content, recommendations, or alerts.
• Account-related activity.

You can manage notification preferences in your device settings at any time.

5. User Content & Objectionable Content

5.1 User Content

You may submit content such as reviews, comments, or photos.

• You retain ownership of your content.
• You grant Cruisimity a license to display and use this content within the App.
• You are solely responsible for the content you post.

5.2 Prohibited Content

You agree not to post content that is:

• Illegal, abusive, harassing, or obscene.
• Infringing on intellectual property rights.
• Misleading, fraudulent, or deceptive.
• Containing malware or harmful code.
• Promoting hate, discrimination, or violence.

5.3 Content Moderation

Cruisimity reserves the right to:

• Review, remove, or restrict content that violates this Agreement.
• Suspend or terminate accounts that repeatedly violate policies.
• Take necessary action to protect users and comply with law.

6. Intellectual Property

All content, trademarks, logos, software, and intellectual property within the App are owned by Cruisimity or its licensors and are protected by applicable laws.

You may not use any intellectual property without prior written permission.

7. Maintenance and Support

Cruisimity is solely responsible for providing support for the App.

Apple has no obligation to provide any maintenance or support services.

8. Warranty Disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The App is provided “AS IS” and “AS AVAILABLE”.
• No warranties are made regarding performance, reliability, or availability.
• Cruisimity does not guarantee uninterrupted or error-free operation.

In the event of App failure, Apple’s sole obligation is limited to refunding the purchase price (if any).

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Cruisimity shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App.

Since the App is free, Cruisimity’s total liability shall not exceed $0.

Apple has no liability whatsoever related to the App.

10. Legal Compliance

You agree to comply with:

• Apple App Store Terms of Service.
• All applicable local, state, federal, and international laws.

You represent that you are not located in a restricted or embargoed country.

11. Third-Party Beneficiary

Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce it against you.

12. Termination

You may terminate this Agreement at any time by deleting the App.

Cruisimity may suspend or terminate access if:

• You violate this Agreement.
• The App is discontinued.
• Required by law.

Upon termination, your license ends immediately.

13. Changes to This Agreement

We may update this Agreement from time to time. Continued use of the App after changes indicates acceptance of the updated terms.

Material changes may be communicated via in-app notice.

14. Governing Law

This Agreement is governed by the laws of [Your State/Country], without regard to conflict of law principles.

15. Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

16. Entire Agreement

This Agreement constitutes the entire agreement between you and Cruisimity regarding the App.
